Terms of Service

These Terms of Service ("Terms") govern your use of the Apiaryum mobile application ("App") operated by:

("we", "us", "our"). By creating an account or using the App, you accept these Terms. If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
By registering an account (including an anonymous account), you confirm that you have read and agree to be bound by these Terms, and that you have read our Privacy Policy. Acknowledging the Privacy Policy is not blanket consent to every processing activity; consent is requested separately where it is the applicable legal basis.
2. Eligibility
You must be at least 16 years old to use the App. By using the App, you represent that you meet this age requirement.
2A. Services, Technical Requirements, and Contract
The electronic services currently provided through the App include account creation and authentication, local and cloud-synchronised management of apiaries, hives, queens, inspections, tasks, history, storage and finances, optional maps and notifications, local voice commands, optional AI-assisted inspection processing, and subscription-status management.
You need a supported Android or iOS device and the current App version. Internet access is required for registration, cloud synchronisation, maps, AI processing, subscriptions, and other online operations; some local management features may work offline. Camera, microphone, notification, and location permissions are required only for features that use them. You are responsible for device and internet charges and for keeping your device reasonably secure.
The contract for free electronic services is concluded when you accept these Terms and create or begin using an anonymous account. It continues until the account is deleted or terminated under these Terms. You may end it at any time by deleting the account in the App. Removing the App without deleting the account does not by itself remove cloud data or cancel an app-store subscription.
3. User Accounts
- Email accounts – you may register with an email address and password. You are responsible for securing your login credentials.
- Anonymous accounts – you may use the App without providing an email. Anonymous accounts have limited functionality (e.g., no cross-device sync, no data recovery after uninstallation). You can convert an anonymous account to a full account at any time.
- You are responsible for all activity under your account.
- You may not create accounts to abuse the App or its features.
4. Use of the App
The App is a beekeeping management tool. You agree to use it lawfully and in accordance with these Terms. You must not:
- Use the App for any illegal or unauthorized purpose.
- Upload harmful, offensive, or infringing content.
- Attempt to interfere with the App's security, infrastructure, or other users' access.
- Decompile, disassemble, or extract source code from the App.
- Use automated systems (bots, scrapers) to access the App.
5. User Content
You retain ownership of all content you create in the App (beekeeping data, photos, audio recordings).
You are solely responsible for the accuracy and legality of your content. We may remove content that violates these Terms.
6. Premium Subscriptions
- The App offers optional premium subscriptions with additional features.
- Subscriptions are billed through Google Play Store or Apple App Store. Payment terms are governed by the respective store's terms.
- You can manage or cancel subscriptions in your app store account settings.
- Subscriptions renew automatically until cancelled in the app store settings.
- Refunds are handled by the app store according to their refund policies.
- We reserve the right to change subscription pricing with appropriate notice.
- If you are an EU consumer, you generally have 14 days from concluding a distance contract to withdraw without giving a reason, subject to applicable statutory exceptions. If you expressly request immediate performance, you may be required to pay proportionally for service supplied before withdrawal; the right is lost only where the law permits and the required express request and acknowledgment have been obtained. App-store procedures may also apply.
- Apiaryum is operated by a natural person under a non-registered business activity in accordance with Art. 5 of the Polish Entrepreneurs' Law of 6 March 2018.
7. AI-Assisted Features
Users may access AI-assisted inspection analysis, with availability and usage limits depending on the current plan. By using this feature:
- You consent to your voice/text data and limited active inspection context being sent to Google Gemini AI for processing.
- You will be asked for separate in-app consent before first use. We may ask you to confirm it again if the feature or the consent terms materially change.
- Availability of AI features may depend on your Premium status, internet connection, model availability, and applicable usage limits.
- You remain responsible for reviewing AI suggestions before saving an inspection or making beekeeping decisions.
- AI-generated content is provided for informational purposes and should not replace professional beekeeping, veterinary, or agricultural advice.
- We are not responsible for the accuracy or completeness of AI-generated analysis.
8. Push Notifications
The App uses Firebase Cloud Messaging (FCM) to deliver push notifications. By enabling push notifications, you consent to receiving messages about:
- Task reminders and inspection alerts.
- App updates and service announcements.
You can disable push notifications at any time in your device settings.
9. Voice Features
Voice-controlled inspection features use on-device speech recognition. Voice models are downloaded to your device and standard audio processing for local KWS commands happens locally. By using voice features, you grant the App permission to access your device microphone only during active voice sessions. The AI-assisted features described in Section 7 may additionally require cloud processing.
10. Intellectual Property
The App, including its design, code, voice models, and branding, is our intellectual property. You may not copy, modify, distribute, or create derivative works based on the App.
11. Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties, express or implied. We do not guarantee that:
- The App will be uninterrupted, error-free, or secure.
- Data synchronization will always be successful or timely.
- The App is suitable for any specific beekeeping decisions. The App is a management tool and does not constitute professional beekeeping, veterinary, or agricultural advice.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of livestock, arising from your use of the App.
Our total liability for any claims arising from these Terms or the use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.
The above limitations of liability do not exclude or limit liability that cannot be excluded or limited under mandatory law, in particular liability for damage caused intentionally or through gross negligence, as well as consumer rights arising from mandatory legal provisions.
13. Account Termination
- You can delete your account at any time through the App settings. Account-linked data is removed from active systems as described in our Privacy Policy, subject to limited security logs, provider backup cycles, disputes, and legal retention obligations.
- We may suspend or terminate your account if you violate these Terms, with notice when feasible.
14. Complaints
Complaints regarding the operation of the App may be submitted to support@apiaryum.com. A complaint should include a description of the problem, contact details, and the email address of the account. We will respond within 14 days of receiving the complaint.
15. Changes to Terms
We may modify these Terms for important reasons, such as changes in law, changes to App functionality, security considerations, or changes involving service providers. We will inform you of material changes at least 14 days in advance through the App or by email. If you do not agree with the changes, you may delete your account before they take effect. Continued use of the App after the changes take effect constitutes acceptance of those changes.
16. Governing Law
These Terms are governed by Polish law. Disputes arising from the use of the App shall be resolved by courts having jurisdiction under Polish law.
If you are a consumer living in another country of the European Union, you retain all consumer rights granted by the law of your country of residence — nothing in these Terms takes those rights away. In particular, you may pursue claims before the court having jurisdiction for your place of residence if the applicable law allows it.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
