Terms of Service

These Terms of Service ("Terms") govern your use of the Apiaryum mobile application ("App") operated by:

("we", "us", "our"). By creating an account or using the App, you accept these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By registering an account (including anonymous accounts), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You must accept these Terms before using the App.

2. Eligibility

You must be at least 16 years old to use the App. By using the App, you represent that you meet this age requirement.

3. User Accounts

• Email accounts – you may register with an email address and password. You are responsible for securing your login credentials.
• Anonymous accounts – you may use the App without providing an email. Anonymous accounts have limited functionality (e.g., no cross-device sync, no data recovery after uninstallation). You can convert an anonymous account to a full account at any time.
• You are responsible for all activity under your account.
• You may not create accounts to abuse the App or its features.

4. Use of the App

The App is a beekeeping management tool. You agree to use it lawfully and in accordance with these Terms. You must not:

• Use the App for any illegal or unauthorized purpose.
• Upload harmful, offensive, or infringing content.
• Attempt to interfere with the App's security, infrastructure, or other users' access.
• Decompile, disassemble, or extract source code from the App.
• Use automated systems (bots, scrapers) to access the App.

5. User Content

You retain ownership of all content you create in the App (beekeeping data, photos, audio recordings, posts, listings, messages). By using social and marketplace features, you grant us a limited license to display shared content to other users as necessary to operate those features.

You are solely responsible for the accuracy and legality of your content. We may remove content that violates these Terms.

6. Social and Community Features

When participating in groups, posts, comments, and private messages, you agree to:

• Treat other users with respect.
• Not post spam, misleading information, or harassing content.
• Not impersonate other users or entities.

We reserve the right to moderate, restrict, or remove content and users that violate these guidelines.

7. Marketplace

The App provides a marketplace for beekeeping-related products and services. When using the marketplace:

Apiaryum acts solely as a platform enabling publication of listings and is not a party to agreements concluded between users. We do not verify the identity of sellers or the quality of the offered goods.

• Sellers are responsible for the accuracy of their listings, pricing, and fulfillment.
• Buyers and sellers transact directly with each other. We are not a party to these transactions and do not guarantee any product or service.
• Listings must comply with all applicable laws.
• We may moderate, reject, or remove listings that violate these Terms or applicable law.
• We are not liable for any disputes between buyers and sellers.

8. Premium Subscriptions

• The App offers optional premium subscriptions with additional features.
• Subscriptions are billed through Google Play Store or Apple App Store. Payment terms are governed by the respective store's terms.
• You can manage or cancel subscriptions in your app store account settings.
• Subscriptions renew automatically until cancelled in the app store settings.
• Refunds are handled by the app store according to their refund policies.
• We reserve the right to change subscription pricing with appropriate notice.
• If you are an EU consumer, you have the right to withdraw from the contract within 14 days of its conclusion without giving any reason. By activating a premium subscription and obtaining immediate access to premium features, you expressly request immediate performance of the service and acknowledge that you lose your right of withdrawal once the service has been fully performed.
• Apiaryum is operated by a natural person under a non-registered business activity in accordance with Art. 5 of the Polish Entrepreneurs' Law of 6 March 2018.

9. AI-Assisted Features

Users may access AI-assisted inspection analysis, with availability and usage limits depending on the current plan. By using this feature:

• You consent to your voice/text data and limited active inspection context being sent to Google Gemini AI for processing.
• You will be asked for separate in-app consent before first use. We may ask you to confirm it again if the feature or the consent terms materially change.
• Availability of AI features may depend on your Premium status, internet connection, model availability, and applicable usage limits.
• You remain responsible for reviewing AI suggestions before saving an inspection or making beekeeping decisions.
• AI-generated content is provided for informational purposes and should not replace professional beekeeping, veterinary, or agricultural advice.
• We are not responsible for the accuracy or completeness of AI-generated analysis.

10. Push Notifications

The App uses Firebase Cloud Messaging (FCM) to deliver push notifications. By enabling push notifications, you consent to receiving messages about:

• Task reminders and inspection alerts.
• Social activity (comments, messages, group updates).
• App updates and service announcements.

You can disable push notifications at any time in your device settings.

11. Collaboration and Data Sharing

The App allows you to grant other users access to your apiaries and beekeeping data through an access control system. When you share access:

• You control what permissions are granted (view, edit, etc.).
• You can revoke access at any time.
• You are responsible for managing who has access to your data.

12. Voice Features

Voice-controlled inspection features use on-device speech recognition. Voice models are downloaded to your device and all audio processing happens locally. By using voice features, you grant the App permission to access your device microphone only during active voice sessions. This applies to local KWS voice commands; the AI-assisted features described in Section 9 may additionally require cloud processing.

13. Market Statistics

We may generate anonymized market statistics (e.g., honey price trends) from aggregated user data. This data:

• Is only published when at least 50 data points are available.
• Cannot identify individual users or listings.
• May be shared publicly for the benefit of the beekeeping community.

14. Intellectual Property

The App, including its design, code, voice models, and branding, is our intellectual property. You may not copy, modify, distribute, or create derivative works based on the App.

15. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties, express or implied. We do not guarantee that:

• The App will be uninterrupted, error-free, or secure.
• Data synchronization will always be successful or timely.
• The App is suitable for any specific beekeeping decisions. The App is a management tool and does not constitute professional beekeeping, veterinary, or agricultural advice.

16. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of livestock, arising from your use of the App.

Our total liability for any claims arising from these Terms or the use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

The above limitations of liability do not exclude or limit liability that cannot be excluded or limited under mandatory law, in particular liability for damage caused intentionally or through gross negligence, as well as consumer rights arising from mandatory legal provisions.

17. Account Termination

• You can delete your account at any time through the App settings. This will permanently delete all your data as described in our Privacy Policy.
• We may suspend or terminate your account if you violate these Terms, with notice when feasible.

18. Complaints

Complaints regarding the operation of the App may be submitted to support@apiaryum.com. A complaint should include a description of the problem, contact details, and the email address of the account. We will respond within 14 days of receiving the complaint.

19. Changes to Terms

We may modify these Terms for important reasons, such as changes in law, changes to App functionality, security considerations, or changes involving service providers. We will inform you of material changes at least 14 days in advance through the App or by email. If you do not agree with the changes, you may delete your account before they take effect. Continued use of the App after the changes take effect constitutes acceptance of those changes.

20. Governing Law

These Terms are governed by Polish law. Disputes arising from the use of the App shall be resolved by courts having jurisdiction under Polish law.

If you are a consumer living in another country of the European Union, you retain all consumer rights granted by the law of your country of residence — nothing in these Terms takes those rights away. In particular, you may pursue claims before the court having jurisdiction for your place of residence if the applicable law allows it.

Consumers may also use the EU online dispute resolution platform available at https://ec.europa.eu/consumers/odr.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
